Officer Involved Shooting During Burglary Investigation

UPDATED RELEASE:

In cooperation with the San Joaquin County District Attorney’s Office and the California Department of Justice, the preliminary investigation into this officer-involved shooting has revealed suspect Sergio Garibay (39 years old from Oakland) used a vehicle and attempted to run over two uniformed Tracy Police Officers (who were on foot) to avoid apprehension after he and several accomplices burglarized trailers at the Best Buy Warehouse. The vehicle (an Infiniti QX80 full-size SUV) Garibay was driving when he attempted to run over the two officers had been reported stolen to
the San Jose Police Department. Garibay and three other people were inside the stolen vehicle during the officer-involved shooting and only the driver (Garibay) was struck by gunfire.

Upon Garibay’s release from the hospital, he will be booked into the San Joaquin County Jail for two counts of 245(c) PC (assault with a deadly weapon on a peace officer), 459 PC (burglary), and 182 PC (conspiracy). Also arrested at the scene were Brenda Prado (27 years old from Oakland) for 459/182 PC (burglary and conspiracy) and Jose Aguilar (36 years old from Oakland) for 459/182 PC (burglary and conspiracy) and 148(a)(1) PC (obstruct/resist/delay a peace officer).

ORIGINAL RELASE: On Sunday, November 19, 2023, around 3:30 am the Tracy Police Department responded to the Best Buy Warehouse in the 6000 block of Hopkins Rd. for a report of a burglary in progress. Multiple suspects were reportedly breaking into trailers parked at the warehouse.


Upon arrival of Tracy PD officers, they located at least two suspects on the property who led them on a short foot chase. Shortly after confronting the suspects, an officer involved shooting occurred. One of the suspects was struck by several rounds and was immediately given medical care by the officers. This injured suspect was transported to a local hospital by ambulance where he is in critical, but stable condition. No officers were injured during the incident.


Two other suspects were detained without injury and a fourth escaped the area on foot. We are actively trying to identify the last suspect, but do not believe there is any risk to the public at this time. The Tracy PD General Investigations Unit is handling this aspect of the investigation.

Representatives from the San Joaquin County District Attorney’s Office and the California Department of Justice are present and will be running a parallel investigation, with our full cooperation, into this incident. This is an ongoing and active investigation, and more details will be released as we learn them.
